Terms & Conditions

Welcome to Western Slope Web Design (“we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your use of our website at https://westernslopewebdesign.com (“Website”) and any related services we offer (collectively, “Services”). By accessing or using our Website or Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Website or Services.

1. Services

We provide website design and related digital services, which may include (but are not limited to) website creation, hosting, maintenance, branding, SEO, Email Marketing, and consulting (“Services”). Specific terms for each service may be set out in separate agreements or proposals.

2. User Responsibilities

  • You agree to provide accurate, current, and complete information when requested.
  • You are responsible for maintaining the confidentiality of any account credentials or passwords.
  • You agree to use our Website and Services lawfully and not to engage in any prohibited activity, including but not limited to:
    1. infringing intellectual property rights;
    2. transmitting harmful or malicious software;
    3. defaming others;
    4. violating any applicable local, state, national, or international law.

3. Payment Terms & Refund Policy

Consultation – No Refund Policy

  • A payment is required at the time of booking to secure your consultation.
  • You may reschedule your appointment with at least 24 hours’ notice.
  • All bookings are non-refundable and cannot be canceled.
  • If you are unable to attend, you may reschedule within the allowed timeframe.

Services – Refund Policy

  • A 50% deposit for services is due at the time of signing the design agreement.
  • If the Client chooses to terminate the agreement prior to 14 days before the final delivery date and provides written notice, a full refund of the deposit will be issued.
  • If the Client terminates the agreement within 14 days of the final delivery date, no refund will be given.
  • Any amounts already paid for completed work, or work in progress, are non-refundable.

4. Design Policies

  • The Client is entitled to two rounds of revisions with each final design.
  • Additional revisions beyond this limit will be billed at $40 per hour.
  • Final design files will be delivered upon full payment of all fees due.
  • The Designer retains the right to showcase the completed design(s) in their portfolio, website, and marketing materials.

5. Intellectual Property

  • Upon full payment, the Client will own all rights to the final approved design(s).
  • The Designer retains ownership of any preliminary drafts, concepts, or unused design elements not included in the final approved deliverables.
  • The Designer retains the right to display the final work in their portfolio and marketing materials.
  • All content, graphics, code, and materials on the Website remain the property of Western Slope Web Design or its licensors unless otherwise agreed.

6. Limitation of Liability & Disclaimer

We strive to provide high-quality Services, but you acknowledge that designs, functionality, and performance may vary. We do not guarantee that the Website or Services will be error-free or uninterrupted.

To the maximum extent permitted by law, our liability arising from or related to these Terms, our Website, or the Services is limited to the amount you paid us under the agreement giving rise to the liability.

We will not be liable for indirect, incidental, special, consequential, or punitive damages, even if we have been advised of the possibility of such damages.

7. Indemnification

You agree to indemnify, defend, and hold harmless Western Slope Web Design and its owners, employees, contractors, agents, from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • your use of our Website or Services;
  • your violation of these Terms;
  • your infringement of any intellectual property or other rights of third parties;
  • any content you submit or your actions in connection with the Services.

8. Privacy

Your privacy is important to us. Our Privacy Policy governs how we collect, use, and disclose information about you. By using our Website or Services, you agree to the terms of our Privacy Policy.

9. Third-Party Links & Services

Our Website or deliverables may include links to third-party websites, tools, or services that are not owned or controlled by us. We are not responsible for the content, policies, or practices of any third parties.

Use of any third-party sites or services is at your own risk and subject to their own terms and privacy policies.

10. Changes to Terms

We may revise these Terms at any time. The revised Terms will be effective when posted on the Website, and your continued use of the Website or Services after such posting constitutes your acceptance of the revised Terms. We may provide notice of material changes via email or on the Website.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Colorado. Disputes will first be resolved through good-faith negotiation, and if necessary, through binding arbitration or court proceedings in Mesa County, Colorado.

12. Miscellaneous

  • Sever-ability: If any provision is held unenforceable, the remainder remains valid.
  • Waiver: Our failure to enforce a right does not waive it.
  • Entire Agreement: These Terms, together with your service agreement, form the complete agreement between us.
